Advertisers and users are responsible for ensuring that advertising content, text, images, graphics, video ("Content") uploaded for inclusion on buyosell.lk complies with all applicable laws. buyosell.lk assumes no responsibility for any illegality or any inaccuracy of the Content.

The advertisers and user guarantees that his or her Content do not violate any copyright, intellectual property rights or other rights of any person or entity, and agrees to release buyosell.lk from all obligations, liabilities and claims arising in connection with the use of (or the inability to use) the service.

Advertisers agree that their Content can may be presented through buyosell.lk 's partner sites under the same terms and conditions as on buyosell.lk.

Copyright

Advertisers grant buyosell.lk a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such Content or incorporate such Content into any form, medium, or technology now known or later developed.

The material (including the Content, and any other content, software or services) contained on buyosell.lk are the property of Buyosell Services (pvt) Ltd, its subsidiaries, affiliates and/or third party licensors. Any intellectual property rights, such as copyright, trademarks, service marks, trade names and other distinguishing brands on the Web Site are the property of Buyosell Services (pvt) Ltd. To be clear: No material on this site may be copied, reproduced, republished, installed, posted, transmitted, stored or distributed without written permission from Buyosell Services (pvt) Ltd.

Watermarks

All images on buyosell.lk are watermarked, which prevents the images to be used for other purposes, without the consent of the advertiser.

Safety and images

buyosell.lk and Buyosell Services (pvt) Ltd reserves the right to change the title of the Content, for editorial purposes. buyosell.lk and Buyosell Services (pvt) Ltd reserves the right not to publish images that are irrelevant or images that violate buyosell.lk 's rules.

Personal

Buyosell.lk and Buyosell Services (pvt) Ltd has the right to cooperate with authorities in the case any Content violates the law. The identity of advertisers, users or buyers may be determined, for example by an ISP. IP addresses may also be registered in order to ensure compliance with the terms and conditions.

Privacy

Buyosell.lk and Buyosell Services (pvt) Ltd will collect information from Users and Advertisers. It is a condition of use of the buyosell.lk that each User and advertiser consents and authorises buyosell.lk and Buyosell Services (pvt) Ltd to collect and use this information. buyosell.lk and Buyosell Services (pvt) Ltd also reserves the right to disclose it to Company Affiliates and any other person for the purposes of administering, supporting and maintaining buyosell.lk, as well as for improving buyosell.lk, for example by using the information for research, marketing, product development and planning.

Cookies

This site uses cookies, which means that you must have cookies enabled on your computer in order for all functionality on this site to work properly. Users are required to submit a valid email address, before they are allowed to post advertisements. The email address of the User shall not be publicly displayed and other users are permitted to send email to the User through buyosell.lk.

Site availability

Buyosell.lk and Buyosell Services (pvt) Ltd does not guarantee continuous or secure access to the Web Site. The Web Site is provided "as is" and as and when available.

Links to third party websites

Buyosell.lk may contain links or references to other websites ('Third Party Websites'). buyosell.lk or Buyosell Services (pvt) Ltd shall not be responsible for the contents in Third Party Websites. Third Party Websites are not investigated or monitored. In the event the user decides to leave buyosell.lk and access Third Party Sites, the user does so at his/her own risk.

Paid content and services

Some content and services of buyosell.lk require payment, including but not limited to, membership packages, posting of ads in select categories, and sale of items through Buy Now, and ad promotions.

Users may purchase ad promotions using vouchers issued or sold by buyosell.lk. Vouchers may not be redeemed for cash.

Advertisers and Users may be required to transmit Paid Content information through a third-party service provider, which may be governed by its own terms of use. Linking to any third party service providers is at the Users' and Advertisers' own risk and buyosell.lk disclaims all liability related thereto. Under no circumstances shall buyosell.lk be obliged to refund any payments made in respect to Paid Content.

Memberships

As part of a membership package, buyosell.lk will create a Shop on behalf of the user. A Shop is a dedicated webpage on buyosell.lk, maintained by buyosell.lk, with content provided by the user. buyosell.lk has the right to any content added to the Shop by the user and has the right to remove or not publish the content if it violates any aspect of the Terms and Conditions.

buyosell.lk reserves the right to modify or change membership packages, including the price and the contents of the membership package.

buyosell.lk is not obligated to refund money or services if a membership package is cancelled early, for any reason.

Buy Now service

Buy Now is a service provided by buyosell.lk to deliver and handle payment of purchases made through buyosell.lk.

buyosell.lk charges a fee ("service charge") to Sellers when an item is delivered to a Buyer and the Buyer pays for the item. If the Buyer is unwilling or unavailable to buy the item, buyosell.lk will return the item to the Seller against payment of a return fee. buyosell.lk reserves the right to amend these fees at any time.

By listing an item for sale on buyosell.lk, Sellers undertake the following:

• To accept delivery of any items ordered by Buyers using “Buy Now” unless the items are out of stock. buyosell.lk reserves the right to delete ads upon refusal of delivery
• To provide for delivery item(s) that match the order received in terms of quality and quantity, as advertised in the listing
• That they have the lawful right and necessary registrations and license to sell the advertised item
• To appropriately pack and prepare the item for delivery. buyosell.lk does not provide installation or dismantling services
• Not to encourage Buyers who have placed orders using “Buy Now” to complete the purchase outside of buyosell.lk
• To accept payment of the item price, minus the service charge, within a reasonable timeframe upon successful sale of an item
• To pay a return fee for return of an item when a Buyer is unwilling or unavailable to purchase the item.
• To pay any taxes due if and when the item is sold.

By placing a “Buy Now” order, Buyers undertake the following:

• To purchase the item unless it is materially different from the description provided by the Seller on buyosell.lk.

buyosell.lk guarantees full payment to the Seller in the event of theft, loss, or damage of the item during the delivery process, within a reasonable timeframe that shall be required for proper investigation and taking of necessary legal measures.

buyosell.lk does not provide any guarantees that Sellers have been truthful or accurate in their listings, have items in stock, will accept the return of an item, or provide any refunds, or that Buyers will complete a transaction successfully. buyosell.lk is not responsible for unsatisfactory or delayed performance, losses, damages or delays as a result of items being unavailable or mishandled by Sellers.

buyosell.lk reserves the right to suspend, limit or withdraw access to buyosell.lk and/or Membership of any user who does not comply with these terms.

Disclaimer

buyosell.lk and Buyosell Services (pvt) Ltd assume no responsibility what so ever for the use of buyosell.lk and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to (a) any errors on buyosell.lk or the Content, including but not limited to technical errors and typographical errors, (b) any third party web sites or content directly or indirectly accessed through links in buyosell.lk, (c) the unavailability of buyosell.lk, (d) your use of ibuyosell.lk or the Content, or (e) your use of any equipment (or software) in connection with buyosell.lk

Indemnification

Advertisers and users agree to indemnify buyosell.lk & Buyosell Services (pvt) Ltd as well as its officers, directors, employees, agents, from and against all losses, expenses, damages and costs, including attorney's fees, resulting from any violation of this Terms and Conditions (including negligent or wrongful conduct).

Modifications

buyosell.lk & Buyosell Services (pvt) Ltd reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on buyosell.lk. You are responsible for the reviewing of such modifications. Your continued access or use of buyosell.lk shall be deemed your acceptance of the modified terms and conditions.
